Terms of Use
The NALL Institute LLC
Version 1.0 · Effective 25 August 2026
Please read these Terms carefully. They include a mandatory arbitration provision and a class action waiver in Part 1, Section 14 that affect how disputes between you and us are resolved.
Part 1 — Terms of Use
Version 1.0 · Effective 25 August 2026
1.Who we are and what this covers
thenallinstitute.com is operated by The NALL Institute LLC, an Alabama limited liability company wholly owned by the Troy University Foundation ("the Institute," "we," "us," "our"). Our address is 414 Equality Street, Fairhope, Alabama 36532.
These Terms govern your use of the website, the A-EYE NALL conversational experience, the portrait generation feature, the NALL Boutique, and every other service we make available at this domain (together, the "Services").
By using the Services you agree to these Terms. If you do not agree, do not use the Services.
The following documents are part of these Terms and are incorporated by reference:
- Privacy— including the Biometric Data Policy, Children's Privacy Notice, and Cookie Notice
- AI Studio Disclosure and Safety Protocol
- Accessibility Statement
- Parts 2, 3, and 4 of this document
2.Eligibility and age
The Services are intended for a general audience and are not directed to children under 13. You must be at least 13 years old to use the website or the A-EYE NALL conversational experience.
You must be at least 18 years old to use the portrait generation feature. That feature requires you to upload a photograph of a face, and we do not accept photographs from or of minors under any circumstances.
If you are under 18, do not upload any photograph to the Services.
If you are between 13 and 18, a parent or legal guardian must review these Terms with you, and purchases from the NALL Boutique must be made by an adult.
See Children's Privacy for how we handle information relating to minors, including how a parent or guardian can request deletion.
3.Your license to use the Services
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and view the Services for your own non-commercial use.
Everything else is reserved.
4.Artwork, archives, and intellectual property
The artworks, photographs of artworks, writings, correspondence, recordings, and archival materials of Fred Nall Hollis ("Nall") that appear on this site are protected by copyright and other rights. Those rights are held or administered by the Institute, the Nall estate, Troy University, and the Troy University Foundation, as applicable. The Institute's use of Nall's name, likeness, voice, biography, and body of work is authorized by the estate and by Troy University.
"The NALL Institute," "A-EYE NALL," "NALL," and associated logos and marks are the property of the Institute or its licensors.
Unless we give you written permission, you may not:
- reproduce, download, screenshot for redistribution, republish, distribute, publicly display, or create derivative works from any artwork image or archival material on this site;
- use any part of the Services for any commercial purpose, including resale, print production, merchandise, licensing, or promotion;
- remove, obscure, or alter any copyright notice, watermark, credit line, or metadata;
- use any automated means — including crawlers, scrapers, bots, or headless browsers — to access, index, download, or copy content from the Services, except that general-purpose search engines may index public pages in a manner consistent with our robots.txt file;
- use any content from the Services to train, fine-tune, evaluate, or otherwise develop any machine learning model, artificial intelligence system, or dataset, whether commercial or non-commercial, and whether or not the output resembles the source. This restriction is a material term of these Terms. We reserve all rights in relation to text and data mining, and we expressly opt out of any text and data mining exception that would otherwise apply;
- attempt to determine, reconstruct, or extract the prompts, system instructions, model weights, training corpus, or underlying architecture of any AI feature.
Nothing here limits fair use under applicable copyright law. If you believe your use qualifies, you take that position at your own risk.
Requests for licensing, reproduction rights, image permissions, or scholarly use go to info@thenallinstitute.com.
5.AI features: what they are and are not
The Services include artificial intelligence features, including A-EYE NALL and portrait generation. Read the AI Studio Disclosure and Safety Protocol before using them. In summary:
A-EYE NALL is software. It is not Nall, not his estate, not a person, and not an authorized spokesperson for anyone. It was built from archival material and it produces output that is frequently wrong. It can fabricate quotations, dates, provenance, exhibition history, and biographical detail that sound authentic and are not. Statements it makes about any real person, living or dead, may be false.
It cannot authenticate, appraise, attribute, or value any artwork. No output constitutes an opinion of the Institute, the estate, Troy University, or any expert. Direct all questions about a specific work to info@thenallinstitute.com.
It is not professional advice. Nothing it produces is legal, financial, medical, psychological, or investment advice.
It is for personal, non-commercial use only. You may not use A-EYE NALL, the portrait feature, or any output from either for any commercial purpose, and you may not use them to build, train, or evaluate any other AI system.
Use of the portrait feature is additionally governed by the Biometric Data Policy, and requires a separate consent that you provide at the point of upload.
6.Content you submit
"User Content" means anything you upload, type, or transmit to the Services, including chat messages and photographs.
Your representations
By submitting User Content you represent and warrant that:
- you are at least 18 years old, if the content is a photograph;
- you own it or have every right necessary to submit it;
- if it depicts a person, that person is you, or that person is an adult who has given you express permission to upload their photograph to an AI portrait service that will process their facial image;
- it does not depict any person under 18;
- it is not unlawful, defamatory, obscene, harassing, or infringing;
- it contains no malware and no personal information about third parties beyond what is described in (c).
License to us
You grant us a limited, worldwide, royalty-free license to host, process, transmit, and display your User Content solely to operate the Services and provide the feature you requested. This license ends when the content is deleted in accordance with our Privacy and Biometric Data Policy. We do not sell your User Content and we do not license it to anyone for advertising.
Generated portraits
Images produced by the portrait feature are generated by software. Works generated by artificial intelligence without sufficient human authorship are generally not eligible for copyright protection in the United States, and we make no representation that any generated image is protected by copyright or that anyone owns it. To the extent we hold any rights in a generated image, we grant you a personal, non-commercial license to keep, display, and share it. You may not sell it, print it for sale, use it in advertising, or represent it as an original work by Nall or as an authenticated work of any kind.
Moderation
We may refuse, remove, or restrict any User Content or any account, for any reason, without notice. We have no obligation to monitor, but we may.
7.The NALL Boutique
Purchases are governed by Part 2 — Boutique Terms, which cover pricing, shipping, returns, refunds, and print-on-demand production. Certain works are listed by inquiry only and are not offered for sale through the site.
8.Third-party services and links
The Services link to and embed third-party platforms including Shopify, our print-on-demand fulfillment partner, and the OpenSea marketplace. Those platforms have their own terms and privacy practices, and we do not control them.
Digital collectibles associated with the Institute are addressed in Part 3 — Digital Collectibles Disclaimer. Nothing on this site is an offer of a security, an investment recommendation, or a representation about the future value of anything.
9.Prohibited conduct
You may not:
- break any law, or use the Services to facilitate anyone else breaking one;
- impersonate any person or entity, including Nall, the Institute, or Troy University;
- upload a photograph of anyone who has not consented, or of anyone under 18;
- attempt to make any AI feature produce sexual content, content sexualizing minors, hate speech, harassment, or instructions for harm;
- probe, scan, overload, or interfere with the Services or any connected system;
- circumvent any access control, rate limit, or technical protection measure;
- resell, sublicense, or commercially exploit any part of the Services.
10.Suspension and termination
We may suspend or terminate your access at any time, with or without notice, for any reason. Sections 4, 6, 11, 12, 13, 14, and 15 survive termination.
11.Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
WE SPECIFICALLY DISCLAIM ANY WARRANTY THAT AI-GENERATED OUTPUT IS ACCURATE, COMPLETE, CURRENT, RELIABLE, OR SUITABLE FOR ANY PURPOSE. AI OUTPUT IS NOT A STATEMENT BY, OPINION OF, OR ATTRIBUTABLE TO THE INSTITUTE, THE NALL ESTATE, TROY UNIVERSITY, THE TROY UNIVERSITY FOUNDATION, OR ANY OF THEIR PERSONNEL. NO AI OUTPUT AUTHENTICATES, APPRAISES, ATTRIBUTES, OR VALUES ANY WORK OF ART.
Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.
12.Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER THE INSTITUTE NOR ANY PROTECTED PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR REPUTATION, ARISING FROM OR RELATING TO THE SERVICES — INCLUDING ANY AI OUTPUT — WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, AND EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (b) ONE HUNDRED U.S. DOLLARS ($100).
Protected Parties
"Protected Party" means the Institute and each of the following, each of which is an intended third-party beneficiary of Sections 11, 12, 13, and 14 and may enforce them directly: Troy University; the Troy University Foundation; the Sorrell College of Business; the NALL Institute for Creative Entrepreneurship; the estate of Fred Nall Hollis and its executors; 223 Agency and its personnel; and the officers, directors, trustees, members, managers, employees, agents, contractors, technology vendors, and fulfillment partners of each of the foregoing.
Some jurisdictions do not allow these limitations, so some of the above may not apply to you.
13.Indemnification
You will defend, indemnify, and hold harmless the Protected Parties from any claim, demand, loss, liability, damage, cost, or expense (including reasonable attorneys' fees) arising from: your use of the Services; your User Content; your upload of any photograph depicting a person who did not consent, or depicting a minor; your breach of these Terms; your violation of any law; or your infringement of anyone's rights.
14.Dispute resolution — arbitration and class action waiver
PLEASE READ. THIS SECTION AFFECTS YOUR LEGAL RIGHTS.
14.1 Informal resolution first
Before starting any proceeding, contact us at info@thenallinstitute.com with a written description of the dispute and the relief you want. We will try in good faith to resolve it within 60 days.
14.2 Binding arbitration
If we cannot resolve it informally, any dispute arising out of or relating to these Terms or the Services will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration will be conducted by a single arbitrator. It may be held by telephone or video, on written submissions, or in person in Pike County, Alabama, at your election. The arbitrator's award may be entered in any court of competent jurisdiction. The Federal Arbitration Act governs this section.
14.3 Class action waiver
YOU AND THE INSTITUTE EACH AGREE THAT DISPUTES WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE CLAIMS AND MAY NOT PRESIDE OVER ANY CLASS OR REPRESENTATIVE PROCEEDING.
If this paragraph is found unenforceable as to any claim, that claim is severed and proceeds in court, and the remainder of this Section 14 continues to apply to all other claims.
14.4 Exceptions
Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court to protect intellectual property rights.
14.5 Opt out
You may opt out of arbitration and the class waiver by emailing info@thenallinstitute.comwith the subject line "Arbitration Opt-Out," including your name and the email address you used, within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms.
14.6 Time limit
Any claim must be brought within one (1) year after it arises, or it is permanently barred, to the extent that limitation is permitted by law.
15.Governing law and venue
These Terms are governed by the laws of the State of Alabama, without regard to conflict of laws principles. Subject to Section 14, any action that proceeds in court will be brought exclusively in the state or federal courts located in Pike County, Alabama, and you consent to that jurisdiction and venue.
16.Changes
We may revise these Terms. When we do, we will update the version number and effective date above, and post the revised Terms here. Material changes will be announced on the site for at least 30 days. Continued use after the effective date means you accept the revision. If you do not accept it, stop using the Services.
17.General
Entire agreement
These Terms and the documents incorporated in Section 1 are the entire agreement between you and us about the Services.
Severability
If any provision is unenforceable, it is modified to the minimum extent necessary or severed, and the rest stays in force.
No waiver
Our failure to enforce a provision is not a waiver of it.
Assignment
You may not assign these Terms. We may assign them to an affiliate or in connection with a transfer of the Services or the Institute's assets.
Force majeure
We are not liable for delays or failures caused by events beyond our reasonable control.
Part 2 — NALL Boutique Terms
Version 1.0 · Effective 25 August 2026
Shipping, returns, refunds, and product terms. These terms apply to everything sold at thenallinstitute.com/boutique. They supplement Part 1 — Terms of Use, which governs in the event of a conflict except where these terms are more specific.
1.Who you are buying from
The seller of record is The NALL Institute LLC, an Alabama limited liability company wholly owned by the Troy University Foundation. 414 Equality Street, Fairhope, Alabama 36532
Checkout is operated by Shopify. Some items are produced and shipped by our print-on-demand partner, [POD_VENDOR]. You are still buying from us, and we handle support.
Purchases must be made by someone 18 or older.
2.What we sell
Print on demand — reproductions, prints, and merchandise manufactured after you order. Produced by [POD_VENDOR] and shipped directly from their facility.
Ready to ship — items held in inventory and dispatched by us.
Digital downloads — files delivered by link after payment clears.
Inquiry only — original works and select editions listed for information. These are not offered for sale through the site. Submitting an inquiry starts a conversation; it is not an offer, a reservation, or a contract, and any sale proceeds under a separate written agreement.
3.Pricing and payment
Prices are in U.S. dollars and may change without notice. The price at checkout is the price that applies.
Applicable sales tax is calculated at checkout.
Payment is processed by Shopify and its payment processors. We never see or store your full card number.
If an item is listed at an incorrect price because of a technical or clerical error, we may cancel the order and refund you in full. We will tell you before doing it.
4.Order acceptance
Your order is an offer to buy. Our confirmation email acknowledges receipt but does not accept it. Acceptance occurs when we ship, or when we deliver a download link.
We may refuse or cancel any order — including for suspected fraud, resale, or a pricing error — and will refund you in full if we do.
5.Production and shipping times
Print on demand: typically [X–X] business days to produce, plus transit. Production time is not shipping time.
Ready to ship: typically [X–X] business days to dispatch.
Digital downloads: available immediately on payment clearing.
These are estimates. Delays happen — carrier problems, weather, holiday volume, supply issues. We will tell you if something is materially late.
Risk of loss passes to you on delivery to the carrier.
We ship within the United States only. We do not currently ship to international addresses, and we cannot accept an order for delivery outside the United States. If you are outside the U.S. and want a work from the collection, email info@thenallinstitute.com and we will tell you what is possible.
6.Returns and refunds
Ready-to-ship items
Return within 30 days of delivery, unused and in original condition and packaging, for a refund of the purchase price. Return shipping is yours unless the item arrived damaged or wrong. Original shipping is not refunded.
Print-on-demand items
These are made to order and are generally not returnable for change of mind, sizing, or preference. Please check size charts and previews before ordering.
We will replace or refund, at no cost to you, if the item is:
- damaged in transit
- defective in manufacture
- materially different from what was shown
- the wrong item or size relative to what you ordered
Email info@thenallinstitute.com within 30 days of delivery with your order number and photographs of the item and the packaging. Photographs are how the claim gets resolved, so please include them.
Digital downloads
Non-refundable once the download link has been accessed, because the file cannot be returned. If the file is corrupted, will not open, or is the wrong item, tell us and we will fix it or refund it.
Original works and inquiry-only items
Governed by the separate written agreement for that sale, not by this section.
How refunds are issued
To the original payment method, within 5–10 business days of approval. Your bank may take longer to post it.
7.Cancellations
Email us immediately at info@thenallinstitute.com. We will cancel if we can. Print-on-demand orders cannot be canceled once production has started, which is often within hours.
8.Product accuracy
We photograph and describe items as accurately as we can. Colors vary between screens and between printers, and reproductions differ from originals in scale, surface, and tone. Minor variation is inherent to print-on-demand production and is not a defect.
Where an item is a reproduction, it is described as one. No item in the boutique is an authenticated original work unless the listing says so explicitly and a certificate accompanies it.
9.Rights in what you buy
Buying a reproduction or a merchandise item gives you the physical object or the file for personal, non-commercial use.
You do not acquire any copyright, reproduction right, or license in the underlying artwork. You may not resell reproductions commercially, produce derivative merchandise, or reproduce the imagery.
Licensing inquiries: info@thenallinstitute.com.
10.Supporting the Institute
Proceeds support the Institute's mission: the preservation of the Nall collection, the museums in Troy and Fairhope, Alabama, and the educational programs of the NALL Institute for Creative Entrepreneurship at Troy University's Sorrell College of Business.
Purchases are commercial transactions, not charitable contributions, and are not tax-deductible. For information about making a gift to the Troy University Foundation, contact us.
11.Warranty and liability
Products are provided as described. To the fullest extent permitted by law, we disclaim implied warranties of merchantability and fitness for a particular purpose. Our liability for any product is limited to the purchase price. Sections 11, 12, 13, and 14 of Part 1 apply, including the arbitration provision and class action waiver.
Nothing here limits any right you have under applicable consumer protection law that cannot be waived.
12.Customer service
info@thenallinstitute.com — include your order number. We aim to respond within 2 business days.

Part 3 — Digital Collectibles Disclaimer
Version 1.0 · Effective 25 August 2026
Some pages on this site link to digital collectibles — commonly called NFTs — listed on OpenSea, a third-party marketplace. Read this before you follow one of those links.
1.Not an investment. Not a security.
Digital collectibles associated with the Institute are offered as collectible items with an associated artwork, for personal enjoyment and collection.
They are not investments. Nothing on this site is an offer or solicitation to buy a security, an investment product, or a financial instrument. Nothing here is investment, financial, tax, or legal advice.
We make no representation whatsoever about future value, resale price, liquidity, scarcity beyond what a listing states, appreciation, or the existence of any market at all. Digital collectibles are volatile, frequently illiquid, and may become worth nothing.
Only spend what you can afford to lose entirely.
2.We do not operate the marketplace
OpenSea is operated by a third party. We do not control it, we do not host it, and we are not responsible for it.
When you leave this site for OpenSea, OpenSea's terms and privacy policy govern, not ours. Transactions happen between you, the marketplace, and the blockchain — not between you and us, unless a listing says otherwise in writing.
We have no ability to reverse a transaction, recover a lost wallet, restore a lost seed phrase, refund a purchase, or intervene in a dispute on that platform.
3.Blockchain risk
- Transactions are irreversible. A mistake is permanent. There is no chargeback.
- You are responsible for your wallet. Lose the keys, lose the asset. No one can restore them.
- Network fees fluctuate and are not set by us.
- Smart contracts can contain defects that cause loss.
- Marketplaces and hosting can disappear. If the platform hosting the associated media goes offline, the token may not display anything.
- Regulation is unsettled and may change in ways that affect value, transferability, or legality in your jurisdiction.
- Fraud is common. Phishing sites, fake collections, and impersonated accounts are endemic to this market.
Verify every contract address independently before transacting. We publish official contract addresses on this site. If a collection claims affiliation with the Institute or with Nall and does not match a contract address published here, treat it as fraudulent.
4.What you get, and what you don't
Owning a digital collectible gives you the token recorded on the blockchain and a personal, non-commercial license to display the associated artwork.
It does not give you:
- copyright or any other intellectual property right in the underlying artwork
- any right to reproduce, print, license, merchandise, or commercially exploit the imagery
- ownership of any physical artwork
- any authentication, provenance opinion, or valuation of any physical work
- any equity, membership, governance right, revenue share, or claim on the Institute, the Nall estate, Troy University, or the Troy University Foundation
Rights in Nall's artworks remain with their holders. Nothing about a token transfers them.
5.Royalties
Any secondary-sale royalty is enforced — or not — by the marketplace, not by us. Marketplaces change royalty policies unilaterally and frequently. We make no representation that any royalty will be collected, honored, or paid.
6.Age and eligibility
You must be 18 or older. You are responsible for confirming that acquiring and holding digital collectibles is lawful where you live, and for your own tax reporting.
7.Relationship to Troy University
The Institute is wholly owned by the Troy University Foundation. Neither Troy University, the Troy University Foundation, nor the Sorrell College of Business endorses, guarantees, underwrites, or is a party to any transaction on OpenSea or any other marketplace. They are Protected Parties under Section 12 of Part 1.
8.Liability
To the fullest extent permitted by law, neither the Institute nor any Protected Party is liable for any loss arising from digital collectibles — including loss of value, loss of access, wallet compromise, marketplace failure, smart contract defect, fraud, or regulatory change. Sections 11, 12, 13, and 14 of Part 1 apply, including arbitration and the class action waiver.
9.Questions
To verify whether a collection is officially associated with the Institute, email us before you transact. We would rather answer that question than the one that comes after.

Part 4 — Copyright and DMCA Policy
Version 1.0 · Effective 25 August 2026
1.The artwork on this site is protected
The artworks, images of artworks, writings, correspondence, photographs, recordings, and archival materials of Fred Nall Hollis shown on thenallinstitute.com are protected by United States and international copyright law. Rights are held or administered by The NALL Institute LLC, the Nall estate, Troy University, and the Troy University Foundation, as applicable.
Presenting them here for viewing does not place them in the public domain and does not license anyone to copy them.
2.What you may not do
Without our written permission, you may not:
- reproduce, download for redistribution, republish, or distribute any artwork image
- print, produce merchandise from, or otherwise commercially exploit any image
- create derivative works
- remove or alter any watermark, credit line, copyright notice, or embedded metadata
- use automated tools — crawlers, scrapers, bots, headless browsers — to harvest images or text, other than general-purpose search engines indexing public pages consistently with our robots.txt
- use any content from this site to train, fine-tune, evaluate, or develop any machine learning model, artificial intelligence system, or dataset
3.Text and data mining: express reservation of rights
The NALL Institute LLC expressly reserves all rights in the content of this site for purposes of text and data mining, machine learning training, and artificial intelligence development.
This is an express reservation under Article 4(3) of EU Directive 2019/790 and any comparable provision in any jurisdiction. It applies to every artwork image, text, transcript, and archival material on this site, including anything reachable through the site's API or produced by any feature on it.
This reservation is machine-readable and is also asserted in our robots.txt and at /.well-known/ai.txt. Ignoring those files does not create a license.
Anyone seeking to use this content for AI training must obtain a written license from us first. We may grant one. Ask.
4.Requesting permission
We license images for scholarly publication, exhibition catalogues, editorial use, education, and commercial reproduction.
Email info@thenallinstitute.comwith the subject line "Permissions" and tell us: the specific work or works, the intended use, the medium and territory, the print run or audience size, and your deadline.
Scholars, students, and educators should say so. Our terms for academic use are different, and generally better.
5.If we are infringing your copyright — DMCA notice
We respect copyright and we expect to be told when we have gotten something wrong. If material on this site infringes a copyright you own or control, send a written notice to our designated agent.
Designated agent
[DMCA_AGENT_NAME]The NALL Institute LLC414 Equality StreetFairhope, Alabama 36532Email: [DMCA_AGENT_EMAIL]
Registered with the U.S. Copyright Office. Registration number: [DMCA_REG_NUMBER]
Your notice must include
Under 17 U.S.C. § 512(c)(3), all six of the following:
- A physical or electronic signature of the copyright owner or someone authorized to act for them.
- Identification of the copyrighted work claimed to be infringed. If multiple works, a representative list.
- Identification of the material claimed to be infringing, with enough detail for us to locate it — a direct URL is best.
- Your contact information: address, telephone number, and email.
- A statement that you have a good faith belief the use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and — under penalty of perjury — that you are authorized to act on behalf of the owner.
An incomplete notice may not be effective. Knowingly making a material misrepresentation may make you liable for damages, including costs and attorneys' fees, under 17 U.S.C. § 512(f).
What we do
We will remove or disable access to the material expeditiously, notify whoever posted it if applicable, and keep a record of the notice.
6.Counter-notice
If your material was removed and you believe that was a mistake or a misidentification, send a counter-notice to the same agent containing:
- Your physical or electronic signature.
- Identification of the removed material and where it appeared before removal.
- A statement under penalty of perjury that you have a good faith belief it was removed as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, any district in which we may be found), and that you will accept service of process from the party who filed the original notice.
We will forward the counter-notice to the original complainant. If they do not file a court action seeking to restrain the activity within 10 to 14 business days, we may restore the material.
7.Repeat infringers
We will terminate, in appropriate circumstances, the accounts and access of users who repeatedly infringe copyright.
8.User uploads
This site accepts user-submitted photographs through the portrait feature. By uploading, you represent that you own or have every right necessary to submit that image and that it does not infringe anyone's rights. See Section 6 of Part 1 and the Biometric Data Policy.
Uploaded photographs are not published, displayed publicly, or made available to anyone else.
9.AI-generated images
Images produced by the portrait feature are generated by software. Works generated by artificial intelligence without sufficient human authorship are generally not eligible for copyright protection in the United States, and we make no representation that any generated image is protected or that anyone owns it.
Generated portraits are not works by Nall, are not in his hand, and are not authenticated as anything. Representing one as an original or authenticated work of Nall may violate these terms and applicable law.
10.Trademarks
"The NALL Institute," "A-EYE NALL," "NALL," "NICE," and associated logos are marks of The NALL Institute LLC or its licensors. "Troy University," "Troy University Foundation," and "Sorrell College of Business" are marks of Troy University. Nothing on this site grants a license to use any of them.
